Sanctions and trade compliance
Draft prepared for OzzBaba. Have a lawyer review it for every country you operate in before relying on it.
OzzBaba operates internationally and must comply with sanctions, export control, anti-bribery and anti-money-laundering laws, including those of Australia, the United Nations, the United States, the European Union and the United Kingdom, and local laws where users are based.
You confirm that
- You, your company, owners, directors and the goods you trade are not subject to sanctions and are not owned or controlled by a sanctioned person.
- You will not use the Marketplace to trade with, or ship to, a sanctioned person, place or sanctioned end use.
- You will not export, re-export or import goods without required licences, permits and customs declarations, including for "dual-use" goods and technology.
- You will not offer, pay, ask for or accept bribes or improper payments, and will not use the Marketplace to launder money or finance crime.
- You will give accurate information about the goods, their origin and their destination.
What we may do
- Decline or limit sign-ups, listings, deliveries and payments linked to certain countries, regions or users. We can switch countries on or off in the Marketplace.
- Ask you for more information (for example proof of identity, ownership or the end user) and pause an order or payout until we have it.
- Cancel orders, hold or return funds, close accounts and report suspected breaches to the authorities, without liability to you, where we reasonably think the law requires it.
Your duty to tell us
Tell us promptly at the contact details on our Help page if any of the statements above stops being true, or if you suspect a transaction on the Marketplace involves sanctions evasion, bribery or money laundering.
Customs and duties
Suppliers, buyers and shipping companies are responsible for customs declarations and duties as set out in the Supplier policy, Buyer policy and Shipping partner policy.
